A Lady Bird Deed (Enhanced Life Estate Deed) is a powerful tool for transferring real estate outside of probate. When used by itself, however, a Lady Bird Deed is not a complete estate plan. It only addresses a single piece of property and does nothing to organize or protect your other assets. That often leaves surviving family members in probate court for everything else.
This product is different. It provides you with a Lady Bird Deed template that transfers your home into your trust. By funding your trust with your home, you centralize control of the property and ensure it is managed according to the trust’s terms. This avoids the problem of multiple beneficiaries needing to agree on every decision about selling or maintaining the property, which is a common issue when Lady Bird Deeds are used without a trust.
A Lady Bird Deed also carries unique benefits when used correctly. It allows you to preserve Medicaid eligibility while protecting your home from the Medicaid Estate Recovery Program (MERP). This means your trust can receive the property without being lost to recovery claims after you pass away.
How it works:
You complete a simple form through our system.
The deed template is generated with your information.
You attach your property’s legal description as Exhibit A. (You are responsible for obtaining this from your deed or county records. We give you instructions for how to do this on your own.)
Once signed, notarized, and filed with the county, your home will be properly titled into your trust.

This is a standalone product. It is included automatically in our Texas Family Trust Plan, so you do not need to purchase it separately if you are purchasing that plan.
This product can be used to fund real estate into any trust, even if the trust was not created through Texan Wills and Trusts.
This product only provides the deed template. You remain responsible for attaching the legal description, signing, notarizing, and filing it with the appropriate county office.
